Melbourne Studio of Art is operated by Art Encounters Pty Ltd, hereon referred to as us/we/our (ACN: 006 472 359 / ABN: 62 006 472 359). All references to you include you and/or all references to students. By enrolling yourself or another student into one of our classes you agree to the following terms. We reserve the right to amend these terms at any time and continued attendance by you after such amendments will constitute acceptance of the amended terms by you.

  1. Enrolment

Melbourne Studio of Art runs adults classes and Melbourne Studio of Art Junior (formerly Art Encounters) runs classes for children and teenagers. Places in our courses are only confirmed upon full and upfront payment of the term fees unless invoiced via a government body. Towards the end of each term, you are automatically reminded by email to enrol for the following term. Your place in the following term will only be confirmed upon full and upfront payment of the next term’s fees. Class sizes are strictly limited to the numbers available via our website, and due to the popularity of our classes we cannot reserve places. Any student who has not been enrolled online while there is availability will be unable to attend the course. We reserve the right to refuse admission or cancel the enrolment of any student who poses a disciplinary problem or disrupts other students, as our teachers are not qualified to manage students with behavioural disorders or students who are unwilling to participate in the scheduled coursework.

  1. Fees

Please contact us or visit the relevant course page on our website for current pricing. Payment for course fees is to be made online only via our website, which ensures that your place is immediately confirmed upon payment. Please contact our office for assistance if you experience technical difficulties while enrolling online.

  1. Refunds & Transfers

Please consider your booking carefully before enrolling as we do not refunds for any missed classes once payment has been processed. Transfers and credits may be considered for booking cancellations 72hrs prior to class commencement. In the event that a class is cancelled by the school, a full refund or credit will be issued. In the case of extenuates circumstances where the is clear documented reasoning that you may not be able to attend, we may consider a partial refund of 75% of the original booking fee.

  1. Trial classes 

While we do not offer trial classes for potential students, please contact us if you would like to organise a complimentary tour of the school to help you determine if a course is suitable for you.

  1. Classes

Courses are designed to be sequential, so we strongly recommend that students attend every class in order to understand and build on the content taught. Students should arrive for their class within and no earlier than 10 minutes of the scheduled start time. Students are not permitted to use mobile phones during class time unless it is to listen to music while working. All phones should be switched to silent otherwise. Tea, coffee, milk and water are readily available in our studio for students. There is also toaster, microwave and small fridge available for students who wish to bring their own lunch to class. Please avoid bringing highly allergenic food into the studio.

  1. Missed classes

We cannot be held responsible for any changes in work or school commitments or personal circumstances of students. We will not issue refunds or transfers for any missed classes.

Special Circumstances:  In the event of illness (with medical certificate) or urgent life events, we will consider replacement classes on a case by case basis.

Children & Teen Classes:  We understand that sometimes children have other school commitments that may interfere with their availability to attend. Melbourne Studio of Art Junior students are offered one make up class per term which must be pre booked to match the missed class’ cycle. Please contact us to arrange your make-up class.

  1. Teachers

We reserve the right to change teachers without notice because of circumstances outside of our control, and we will not issue a refund or transfer if there has been a change in the teacher of a class that you are enrolled in. You agree that students are enrolled to undertake the course and there is no guarantee as to who the teacher will be.

  1. Reviewing work made outside of classes

Students may occasionally request their teacher to review work created at home, provided it is strictly related to the content of the class or homework recommended by the teacher. Work that is independent of class content and completed outside of the studio may only be reviewed by appointment, and a tutorial fee of $100 per hour will be charged. Students who request a review of work are asked to keep in mind that they are requesting a professional assessment from a professional artist, who is under no obligation to offer encouragement or discouragement, and that it is inappropriate to interpret any remarks regarding their work as personal criticism.

  1. Supplies

Basic art aprons are supplied to all students to wear during class time, and all materials are supplied during Sunday Workshops. However, all students are required to bring or purchase their own materials for term courses. Material kits are available to purchase on check out on our online booking engine. Kits purchased through the school are priced with a 20% discount, and can be picked up at the beginning of the first class. If you do not require the full material kit, individual items can be purchased in person at the studio during regular business hours. Please contact our office if you need a material list emailed to you.

  1. Gift Vouchers

Gift vouchers are available to purchase in studio or over the phone and remain valid for up to 3 years from the purchase date. Please note that gift vouchers are non-refundable, and do not guarantee a place in one of our programs.

  1. Photography

We may take photographs of students participating in class or any artwork they create in class and publish them on our website and social media pages, or for other advertising and publicity purposes. If you do not want you or your artwork to be photographed, we ask that you inform us before the commencement of the term. Nevertheless, if at any time you request that we remove any images of you or your artwork, we will endeavour to do so as soon as possible.

  1. Personal property

We cannot be held responsible for any personal property you bring onto the premises, and we cannot be liable for any loss or damage to such property. For this reason, we recommend that students do not bring any valuables to class.

  1. Lost or damaged artwork

We cannot be held responsible for any lost or damaged artwork belonging to students. It is the responsibility of each student to collect their artwork at the end of each term, as any uncollected artwork may be removed or disposed of.

  1. Medical Care

Trained staff will provide basic first aid to the best of their ability in the event of a medical emergency. While we require that you inform staff of any medical conditions or allergies you have, we will not be responsible for the administration of any medicines you need throughout the class.

  1. Emergency contact

If you are the parent or guardian of a student, we request that you are contactable via your registered details for the duration of each class, in the event of an emergency.

  1. Disclaimers

While we use appropriate materials in our classes, you acknowledge that to the extent permitted by law, we cannot be responsible for any damage to your attire or personal property from the use of these materials. While we do everything possible to maintain a high standard of supervision in our classes to ensure the safety of students while they are on our premises, we cannot be responsible for the safety of students outside of classes. You acknowledge that to the extent permitted by law, we are not responsible for the safety of students outside their class time or outside our premises.

  1. Feedback

  1. Severability

If any part of these terms is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

  1. Entire agreement

Upon payment of our fees, these terms, as amended from time to time, shall represent the entirety of the agreement between you and us, and any changes must be in writing and agreed to by us to have effect.

20. Covid 19 Response

In the event of a future lock down all classes will move online. Information about these changes will be communicated with all enrolled students and parents via email.
